KPH: Wilayah Natumingka Masuk Kawasan Hutan Produksi | OBROLANBISNIS.com — Kesatuan Pengelolaan Hutan (KPH) IV Balige menyatakan, secara hukum wilayah Natumingka masih berada di kawasan Hutan Produksi, yang kini masuk didalam konsesi Hutan Tanaman Industri (HTI) PT Toba Pulp Lestari, Tbk (TPL).
“Sehingga perusahaan pengelola pemanfaatan hasil hutan, dibebankan dan wajib untuk melakukan pengawasan dan pengamanan lahan. Bila tidak dilakukan, maka izin akan dievaluasi,” ungkap Kepala KPH IV Balige Leonardo Sitorus menjawab sejumlah pertanyaan media terkait hutan adat Desa Natumingka Kecamatan Borbor Kabupaten Toba, kemarin.
Terkait Natumingka mulai dari lahan register sudah merupakan kawasan hutan, sesuai Surat Keputusan Menteri Kehutanan (SK Menhut) tentang Tata Guna Hutan Kesepakatan (TGHK) tahun 1984. “Kawasan ini menjadi kawasan Hutan Produksi. Juga diatur dalam SK Menhut nomor 44 tahun 2005 yang menyebutkan kasawasan tersebut menjadi kawasan hutan lindung,” beber Leonardo Sitorus, melalui telepon selular miliknya.
Lebih lanjut dia juga menjelaskan, SK Menhut nomor 44 tahun 2005 kembali direvisi, dan diganti dengan SK Menhut nomor 579 tahun 2014 yang menyebutkan, kawasan tersebut kembali menjadi kawasan Hutan Produksi (HP) tetap, dan dilakukan tapal batas, sehingga dikembalikan fungsi awalnya.
Kemudian Leonardo Sitorus juga menjelaskan kementerian kembali mengeluarkan SK Menhut nomor 1076 tahun 2017 tentang Perkembangan Pengukuhan kawasan Hutan di Provinsi Sumatera Utara. Dalam surat keputusan tersebut dikatakan wilayah Natumingka adalah kawasan Hutan Produksi, sehingga tetap masih dikelola oleh perusahaan (TPL).

“Pemerintah juga mengeluarkan SK Menhut nomor 8088/Menlhk-PKTI/KUH/PLA.2/11/2019 tentang perkembangan tapal batas kawasan hutan di provinsi Sumatera Utara, isinya kawasan Natumingka tetap dalam lahan konsesi TPL dan dibebankan untuk menjaga kemanan dan pengawasan,” tegasnya.
Menurut Leonardo Sitorus, pihaknya juga telah melakukan investigasi dan inventarisir, terhadap kawasan Natumingka yang diklaim sebagai tanah adat oleh masyarakat. Termasuk keberadaan situs makam, bekas persawahan dan bekas perladangan. Hasilnya memang kawasan terebut adalah wilayah konsesi (HTI) perusahaan.
Hasil inestigasi dan inventarisir dari KPH IV Balige telah disampaikan melalui surat kepada masyarakat Natumingka, dan ditembuskan ke sejumlah instansi terkait termasuk pihak kepolisian Poles Toba. Namun untuk menyelesaikan perselisihan tersebut, KPH IV Balige memberikan rekomendasi diantara kedua belah pihak.
“Masyarakat harus mengurus klaim hutan adat secara legal formal, ketika telah ditetapkan oleh menteri bahwa kawasan tersebut adalah hutan adat, maka masyarakat dapat mengelola kawasan yang dimaksud sebagai hutan adat.

Atau bila masyarakat mengklaim bahwa lahan tersebut adalah milik keturunan opung (Nenek Moyang) mereka, maka dapat dilakukan pelepasan kawasan hutan melalui Tanah Objek Reformasi Agraria (TORA) sesuai persyaratan dan undang-udang yang berlaku.
“Selagi belum penetapan dari yang berwenang tentunya status hukum kawasan hutan tersebut adalah hutan produksi tetap yang dibebankan kepada TPL sesuai dengan Izin Usaha Pemanfaatan Hasil Hutan Kayu (IUPHHK) HTI TPL,” ucapnya.
Untuk mengatasi perselisihan tersebut, KPH IV Balige juga memberikan masukan kepada perusahaan dan masyarakat, yakni melaksanakan kegiatan kemitraan dengan pola tumpang sari atau sejenisnya yang sesuai dengan peraturan Menteri Kehutanan.
Dalam hal ini pihak perusahaan (TPL) melakukan kegiatan sesuai dengan hak serta kewajibannya, melakukan kemitraan dengan masyarakat dengan tidak mengganggu sejumlah situs yang telah diinventarisir oleh pihak KPH IV Balige.
“TPL melakukan hak dan kewajibannya dengan memperhatikan kesejahteraan masyarakatsesuai peraturan dan perundang-undangan,” harap Leonardo Sitorus. ***

Then Leonardo Sitorus also explained that the ministry had again issued Forestry Minister Decree number 1076 of 2017 concerning the Development of the Establishment of Forest Areas in North Sumatra Province. The decree states that the Natumingka area is a Production Forest area, so that it is still managed by the company (TPL).
“The government also issued Forestry Ministerial Decree number 8088 / Menlhk-PKTI / KUH / PLA.2 / 11/2019 regarding the development of forest area boundaries in North Sumatra province, the contents of which the Natumingka area remains within the TPL concession and is charged to maintain security and supervision,” he stressed.
According to Leonardo Sitorus, his party has also conducted an investigation and an inventory of the Natumingka area which is claimed as customary land by the community. Including the existence of grave sites, former rice fields and former farming areas. The result is that the area is the company’s concession area (HTI).
The results of investigations and inventories from KPH IV Balige have been submitted by letter to the Natumingka community, and copied to a number of related agencies including the Toba Police. However, to resolve the dispute, KPH IV Balige provided recommendations between the two parties.

Or if the community claims that the land belongs to the descendants of their opung (ancestors), then the forest area can be released through the Land for Agrarian Reform Objects (TORA) in accordance with applicable requirements and laws.
“While it has not been determined from the authorities, of course, the legal status of the forest area is a permanent production forest which is borne by TPL in accordance with the TPL HTI HTI Timber Forest Product Utilization Business Permit (IUPHHK),” he said.
To resolve the dispute, KPH IV Balige also provides input to the company and the community, namely carrying out partnership activities with an intercropping pattern or the like in accordance with the Minister of Forestry regulations.
In this case the company (TPL) carries out activities in accordance with its rights and obligations, partnerships with the community by not disturbing a number of sites that have been inventoried by KPH IV Balige.
