Yang menjadi viral saat ini bukan keindahan lokasi wisatanya melainkan kasus sengketa lahan Puncak Laut Tawar, yang kini sedang bergulir di ranah hukum. Karena pemilik areal wisata itu melaporkan penyerobotan lahan ke polisi.
Bahkan, kini lokasi wisata Puncak Laut Tawar yang dikenal juga dengan nama Puncak Sinarta Rumah Tuan telah diportal oleh oknum-oknum yang tidak bertanggungjawab. Tersiar kabar, yang melakukan pemasangan portal tersebut disebut-sebut AM dan TPM, duo bersaudara bermarga Malau yang mengaku dari pihak PT SPS.
Kabar yang diperoleh, tindakan pemasangan portal ini dilakukan usai kedatangan tim dari Polres Simalungun dan BPN, yang seolah-olah kedatangan lembaga negara tersebut melegitimasi bahwa lahan tersebut adalah milik PT SPS secara sah.
Pemilik lahan wisata Puncak Laut Tawar bernama Karya Bhakti Purba melaporkan oknum yang mengatasnamakan PT SPS karena diduga telah menyerobot lahan dan melakukan tindakan arogan mengusir pengelola kantin serta mencabut plank lokasi Puncak Laut Tawar, 6 Oktober 2021.
Laporan itu bernomor surat STPL/178/X/2021/SPKT/RES SIMALUNGUN/POLDA SUMUT tertanggal 6 Oktober 2021, melaporkan oknum yang berinisial AM tersebut atas peristiwa pelanggaran pidana UU nomor 1 tahun 1946 tentang KUHP pasal 385 yang terjadi pada tanggal 14 September 2021 di Dusun Hapoan Naga Meriah, Kabupaten Simalungun.
Penerima kuasa penuh untuk mengelola menjadi lokasi Pariwisata (akta notaris) dari Pemilik Tanah, Benson Kaban mengatakan, AM Cs juga telah membakar pondok yang tadinya berfungsi sebagai kantin dan mengeluarkan dengan paksa seluruh Isi barang-barang kantin di Puncak Laut Tawar tersebut.

“Mereka bahkan menjadikan mushola sebagai base camp untuk orang jaga malam. Tindakannya ini benar-benar keterlaluan,” kesal Benson.
Marjan Girsang selaku Koordinator Tanamanan Pangan mengatakan, pihak PT SPS mendozer tanaman warga, seperti padi, jagung, kol, kentang, bawang dan kopi di areal perladangan tersebut.
Padahal areal itu sedang dalam persiapan pengembangan dengan nama Roemah Tuan Agroforestry, pidzem madu atau kotak lebah untuk produksi madu hutan, serta pengembangan tanaman tembakau. Akan tetapi semuanya sudah dirusak oleh AM Cs.
Anehnya lagi, kata Benson, mereka justru mempromosikan lokasi ini sebagai lokasi wisata miliknya lewat platform FB-nya sudah dikasih nama Taman Bunga Soadamara dan Rest Area SPS Nauli bahkan mereka juga menawarkan tanah bagi yang ingin membuat villa di lokasi.
Terkait terteranya nomor sertifikat tanah dalam plank yang didirikan AM Cs, Benson menduga sertifikat PT SPS itu bukan berstatus SHM melainkan HGU atau HBG.

“Pertanyaannya jika memang HGU atau HGB, PT SPS mendapatkan hak tersebut dari mana?? HGU dan HGB bukan hak milik, mirip hak sewa. Jika PT SPS punya sertifikat HGU, tidak ada pernah Usaha PT SPS di lokasi tersebut, fisik tanah pun tidak pernah dipegang. Jika HGB tidak ada pernah mereka membangun dengan bangunannya yang disertifikatnya. Intinya tanah bukan milik PT SPS,” tegas Benson.
Itu juga yang menjadi alasan Benson enggan menemui oknum preman yang mengatasnamakan PT SPS ini.
“Maka saya sebagai pribadi, tidak mau menemui bahkan menghubungi nomor konfirmasi yang dipasang di plank. Feeling saya, gaya dagang seperti ini akan bangkrut dengan sendirinya. Menakut-nakuti, hanya orang penakut yang takut. Sepanjang kita berpegang teguh kepada nilai-nilai kebebaran, data dan fakta,” ujar Benson Kaban akhiri wawancara kepada awak media di sekitar Kantor Camat Pematang Silima Huta, Tiga Raja.
Sementara itu, Karya Bhakti mengeluhkan atas situasi yang dihadapinya. Ia mengesalkan tindakan oknum PT SPS dan AM Cs yang diduga menyerobot lahannya dan mengaku sebagai pemilik. Padahal, Karya Bhakti memiliki sertifikat tanah berstatus SHM.
“Jelas-jelas saya membeli tanah dari warga desa dan banyak saksinya, tanah saya selain sebagian besar adalah SHM (Sertifikat Hak Milik) dengan 7 pucuk sertifikat. 3 surat dengan akta jual beli dinotaris yang sebagai besar warga desa ikut menjual dengen pelepasan hak yang jelas, tanah yang dipuncak merupakan tanah kampung (kepemikikan kolektif) yang dijual ke saya,” ujar Karya Bhakti Purba.
Sementara sebagian lainnya, ia beli dari warga setempat dengan surat desa. “Selama ini tidak ada masalah, maka saya terkejut dengan tindakan brutal ini,” keluhnya.
Terkait persoalan ini pihak PT SPS yakni AM belum memberikan tanggapan. Saat dikirimkan pesan lewat Whatsapp beberapa waktu lalu, AM mengatakan akan segera memberi kabar. ***

“They even made a place of worship as a base camp for night watchmen. This action is really outrageous,” Benson annoyed.
Marjan Girsang as the Coordinator of Food Crops said that PT SPS dozes residents’ crops, such as rice, corn, cabbage, potatoes, onions and coffee in the cultivated area.
Whereas the area is currently in preparation for development under the name Roemah Tuan Agroforestry, honey pidzem or bee box for the production of forest honey, as well as the development of tobacco plants. However, everything has been damaged by AM Cs.
Surprisingly, said Benson, they actually promote this location as a tourist location of their own through their FB platform, which has been given the name Taman Bunga Soadamara and Rest Area SPS Nauli and they even offer land for those who want to build a villa on site.
Regarding the number of land certificates listed in the plank established by AM Cs, Benson suspects that the PT SPS certificate is not a SHM status but HGU or HBG.
“The question is if it is HGU or HGB, where did PT SPS get the rights from? HGU and HGB are not property rights, similar to lease rights. If PT SPS has a HGU certificate, there has never been any PT SPS business in that location, the physical land has never been held. If there was no HGB, they never built the building with the certificate. The point is the land does not belong to PT SPS,” said Benson.
That is also the reason Benson is reluctant to meet these thugs who are on behalf of PT SPS.
“So I personally don’t want to meet and even call the confirmation number posted on the plank. My feeling, this kind of trading style will go bankrupt by itself. It scares, only cowards are afraid. As long as we stick to the values of humility, data and facts,” said Benson Kaban ending the interview with the media crew around the Pematang Silima Huta Sub-district Office, Tiga Raja.
Meanwhile, Karya Bhakti complained about the situation he was in. He deplored the actions of PT SPS and AM Cs who allegedly took his land and claimed to be the owners. In fact, Karya Bhakti has a land certificate with the status of SHM.
“Obviously I bought land from villagers and there are many witnesses, besides most of my land is SHM (Certificate of Ownership) with 7 certificates. 3 letters with a notarized sale and purchase deed which most of the villagers participate in selling with a clear release of rights “The land at the top is village land (collective ownership) which was sold to me,” said Karya Bhakti Purba.
While others, he bought from local residents with village letters. “So far there have been no problems, so I am shocked by this brutal act,” he lamented.
