Ini Peraturan Perizinan Ekspor dan Impor Yang Baru | Permendag Lama Tak Berlaku Lagi | OBROLANBISNIS.com — Menteri Perdagangan Muhammad Lutfi telah menerbitkan Peraturan Menteri Perdagangan (Permendag) nomor 19 tahun 2021 tentang Kebijakan dan Pengaturan Ekspor dan Permendag nomor 20 tahun 2021 tentang Kebijakan dan Pengaturan Impor yang telah berlaku pada 15 November 2021.
Kedua Permendag tersebut merupakan produk hukum turunan Undang-undang nomor 11 tahun 2020 tentang Cipta Kerja.
Dengan berlakunya kedua Permendag baru ini, maka semua peraturan dalam Permendag terkait ekspor dan impor sebelumnya kini telah dicabut dan dinyatakan tidak berlaku lagi.
Namun, perizinan berusaha yang telah diterbitkan berdasarkan peraturan sebelumnya dinyatakan tetap berlaku sampai dengan masa berlakunya berakhir.

Selengkapnya mengenai ketentuan ini diatur dalam Pasal 49 dan Pasal 50 Permendag nomor 19 tahun 2021 untuk perizinan berusaha di bidang ekspor; dan Pasal 52, Pasal 53, dan Pasal 54 Permendag Nomor 20 Tahun 2021 untuk perizinan berusaha di bidang impor.
Plt Direktur Jenderal Perdagangan Luar Negeri, Indrasari Wisnu Wardhana menyampaikan, salah satu perubahan penting dalam pengaturan perizinan ekspor impor dengan berlakunya kedua Permendag ini adalah implementasi Single Submission (SSm), yaitu pengajuan perizinan melalui Sistem Indonesia National Single Window (INSW).
Tujuannya, adanya data yang terintegrasi antar K/L dan menjadi superset data untuk menghilangkan repetisi dan duplikasi.
Perizinan ekspor impor, lanjut Wisnu, kini semakin mudah dan cepat dengan integrasi sistem INATRADE dengan sistem INSW. Pelaku usaha mengajukan permohonan melalui Sistem INSW, yang merupakan hub untuk sistem pelayanan perizinan di seluruh K/L terkait.

Sehingga pelaku usaha tidak perlu lagi membuka portal K/L terkait untuk memenuhi persyaratan perizinan, khususnya di bidang ekspor dan impor.
“Selain kecepatan dan kemudahan, perizinan berusaha ekspor impor yang diterbitkan dengan sistem Single Submission (SSm) ini juga menggunakan tanda tangan elektronik (digital signature) dan barcode untuk memberikan jaminan keaslian dan keamanan data dan informasi dalam dokumen perizinan berusaha,” jelas Wisnu.
Menurut Wisnu, pada saat awal implementasi Single Submission (SSm) perizinan, memang masih terdapat kendala dalam integrasi sistem, yaitu beberapa elemen data yang dikirim melalui Sistem INSW belum sesuai dengan elemen pada sistem INATRADE. Hal ini menyebabkan permohonan yang diajukan pelaku usaha tidak terkirim ke sistem INATRADE dan tidak dapat diproses lebih lanjut.
Namun, Kemendag dan Lembaga National Single Window (LNSW) terus melakukan koordinasi secara teknis, dan saat ini proses perizinan sudah mulai berjalan normal.
Selain itu, ketika Single Submission (SSm) perizinan diberlakukan, banyak pelaku usaha yang belum terbiasa menggunakan sistem baru. Untuk mengatasi hal ini, baik LNSW maupun Kementerian Perdagangan melakukaan sosialisasi, asistensi, dan konsultasi melalui aplikasi Zoom, serta panduan melalui video tutorial.

Sampai dengan 11 Desember 2021 pukul 19.00 WIB, dari 4.548 permohonan yang masuk ke sistem INSW, sebanyak 3.882 permohonan telah diterima oleh INATRADE.
Dari jumlah permohonan yang diterima INATRADE tersebut, sebanyak 2.032 permohonan dikembalikan (rollback) karena tidak lengkap dan tidak sesuai dengan persyaratan, 1.608 permohonan telah diterbitkan, dan sisanya masih dalam proses.
“Kendala perizinan yang dihadapi saat ini bukan disebabkan aturan, tetapi karena belum terbiasanya pelaku usaha menggunakan sistem SSm perizinan,” tutup Wisnu. ***
This is the New Export and Import Licensing Regulation | Old Permendag No Longer Valid | OBROLANBISNIS.com — Minister of Trade Muhammad Lutfi has issued Minister of Trade Regulation (Permendag) number 19 of 2021 concerning Export Policy and Regulations and Regulation of the Minister of Trade number 20 of 2021 concerning Import Policies and Regulations which has taken effect on November 15, 2021.
The two Permendag regulations are legal products derived from Law No. 11 of 2020 concerning Job Creation.
With the enactment of these two new Ministerial Regulations, all regulations in the previous Minister of Trade concerning exports and imports have now been revoked and declared no longer valid.
However, business licenses that have been issued based on the previous regulations are declared to remain valid until their validity period ends.
Details regarding this provision are regulated in Article 49 and Article 50 of the Minister of Trade Number 19 of 2021 for business licensing in the export sector; and Article 52, Article 53 and Article 54 of the Minister of Trade Regulation Number 20 of 2021 for business licensing in the import sector.
The Acting Director General of Foreign Trade, Indrasari Wisnu Wardhana, said that one of the important changes in the regulation of import-export licensing was the enactment of the two Ministerial Regulations.
This is the implementation of the Single Submission (SSm), namely the application of permits through the Indonesia National Single Window (INSW) System.
The goal is to have data that is integrated between K/L and becomes a data superset to eliminate repetition and duplication.
Import export licensing, continued Wisnu, is now easier and faster with the integration of the INATRADE system with the INSW system. Business actors submit applications through the INSW System, which is the hub for the licensing service system in all relevant K/Ls.
So that business actors no longer need to open relevant K/L portals to fulfill licensing requirements, especially in the field of finance export and import.

According to Wisnu, at the beginning of the implementation of the licensing SSm, there were still obstacles in system integration, namely that some data elements sent through the INSW System did not match the elements in the INATRADE system. This causes the application submitted by the business actor to not be sent to the INATRADE system and cannot be processed further.
However, the Ministry of Trade and the National Single Window Institution (LNSW) continue to coordinate technically, and currently the licensing process has started to run normally.
In addition, when the licensing system was implemented, many business actors were not used to using the new system. To overcome this, both LNSW and the Ministry of Trade carry out socialization, assistance, and consultation through the Zoom application, as well as guidance through video tutorials.
As of December 11, 2021 at 19.00 WIB, out of 4,548 applications that have entered the INSW system, a total of 3,882 applications have been received by INATRADE.
From the number of applications received by INATRADE, 2,032 applications were rolled back because they were incomplete and did not meet the requirements, 1,608 applications had been issued, and the rest were still in process.
