Penahanan Kapal MV Mathu Bhum | Sugianto: Danlantamal I Belawan harus Bertanggungjawab | OBROLANBISNIS.com — Danlantamal I Belawan harus bertanggungjawab atas penahanan Kapal MV Mathu Bhum. Karena telah merugikan material dan inmaterial yang dialami petani dan nelayan.
“Dalam kasus ini, saya menemukan pelanggaran hukum oleh aparat yang sudah melampaui kewenangannya dan melanggar tupoksi. Dari penahanan itu telah memunculkan efek domino yang lebih besar, baik dari segi material dan inmaterial,” ungkap Anggota DPRD Sumut Fraksi PDI-P, Sugianto Makmur.
Hal itu disebutkan politisi PID-P usai menerima aspirasi para pelaku usaha yang tergabung dalam organisasi Asosiasi Pengusaha Indonesia Sumatera Utara (APINDO Sumut), Rabu, 15 Juni 2022, di gedung dewan.
Menurut pria berkacamata ini, dari segi material yang timbul, pastinya barang-barang yang ditahan didalam kapal tersebut sudah menurun kualitas dan tidak bisa dipakai.
“Kerugian material ini siapa yang menanggung. Nilai materi mencapai ratusan milyar! Apa Danlantamal dengan aksinya menahanan kapal tersebut sudah memikirkan kerugian material itu,” ucap Sugianto.
Yang lebih parah lagi yang dialami adalah kerugian inmaterial. “Yaitu kepercayaan pembeli di luar negeri sudah tidak ada atau berkurang kepada pelaku usaha asal Sumut. Kemungkinan besar pembeli luar negeri tidak akan mau beli lagi barang dari Belawan, Sumut,” cetusnya.

Kapal yang ditahan Lantamal I Belawan pada 4 Mei 2022 lalu, sebagian dari barang bawaannya, merupakan hasil laut dan pertanian. “Lalu bagaimana nasib petani dan nelayan kita, siapa yang mau bertanggungjawab atas kerugian inmaterial, yang dapat mematikan kehidupan puluhan ribu hingga jutaan jiwa,” bebernya.
Mengapa demikian dikatakan begitu, lanjut Sugianto, karena efek penahanan satu kapal ini saja akan membuat pembeli melihat citra keamanan di negeri. “Kapal muatan barang komoditas tiba-tiba saja bisa ditangkap oleh aparat yg bukan tugasnya. Pasti akan memunculkan ketidakpastian hukum dan kepercayaan dalam berinvestasi,” jelasnya seraya menambahkan, pastinya eksportir Sumut akan tidak lagi dipercaya.
Ia menyebutkan, dalam kasus penahanan Kapal MV Mathu Bhum oleh Lantamal I Belawan jangan dilihat dari nilai kontainer yang diamankan saja, tapi efek inmaterial yang ditanggung lebih besar lagi.
Legislator Sumut ini meminta Danlantamal I Belawan harus bertanggungjawab sepenuhnya atas aksi heroik penangkapan kapal di perairan Belawan.
“Kita minta agar kapal beserta muatannya dibebaskan. Karena dalam penahanannya tanpa prosedur dan aturan yang sudah ada. Tanpa surat penahanan, tanpa sita dan tanpa penetapan kasus yang jelas,” ucap Sugianto.
Ia mengaku telah berkoordinasi dengan Bea Cukai di Belawan atas penangkapan kapal tersebut. “Hasil penjelasannya, bahwa kapal MV Mathu Bhum tidak ada melakukan pelanggaran pabeaan dalam hal ini penyelundupan ataupun peraturan Kementerian Perdagangan nomor 22 tahun 2022 tentang pelarangan ekspor,” beber Sugianto.

Sugianto berpesan kepada Kejaksaan agar tidak melibatkan diri dalam kesalahan yang dilakukan Lantamal I Belawan. “Dan saya minta Panglima TNI mengkoreksi hal ini. Sebab, belum ada dalam sejarah negara ini, lembaga TNI melakukan proses penyidikan sipil. Dalam kasus ini harusnya angkatan laut menyerahkan kasusnya pada pihak Kepolisian, Bea Cukai atau pihak Syahbandar untuk proses penyelidikan dan penyidikan,” ulasnya.
Fraksi PDIP DPRD Sumut akan mengambil langkah, melaporkan ke Presiden hingga Panglima TNI, agar ke depan tidak terulang kembali kejadian arogansi penahanan kapal-kapal lainnya.
Sementara itu perwakilan eksportir sayur sayuran Sumut, Syahril Rudi Siregar berharap kepada pemerintah untuk segera menyelesaikan kasus ini. “Kita tidak tahu sapa benar dan salah dalam kasus ini, yang kami harap kepastian hukumnya,” katanya.
Ekspor sayur-sayuran ini adalah bisnis kepercayaan antara buyer dan seller. “Dalam kasus ini, kita khawatirkan munculnya ketidakpercayaan buyer kepada kami sebagai eksportir Sumut. Sehingga, tidak akan ada lagi permintaan ekspor sayur-sayuran kepada kami,” bebernya.
Kondisi yang dialami saat ini setelah 40 hari penahanan Kapal MV Mathu Bhum, dipastikan sayur-sayuran (jenis sayur kol) telah rusak. “Kami tidak ingin mengirimkan barang yang rusak kepada buyer. Double rugi namanya yang telah kami alami. Pertama, rugi material dan kedua hilangnya kepercayaan buyer luar negeri,” jelasnya.
Ketua DPP APINDO Sumut, Dr Haposan Siallagan berterimakasih kepada Anggota DPRD Sumut Fraksi PDIP yang telah menampung aspirasi para pelaku usaha dan UMKM Sumut.

This was stated by the PID-P politician after receiving the aspirations of business actors who are members of the North Sumatran Indonesian Employers’ Association (APINDO Sumut) organization, Wednesday, June 15 2022, in the council building.
According to this bespectacled man, in terms of the material that appears, it is certain that the items held on the ship have decreased in quality and cannot be used.
“Who will bear this material loss? The material value reaches hundreds of billions! Did Danlantamal with his actions detaining the ship have thought about the material loss,” said Sugianto.
What was even worse was the immaterial losses. “That is, the trust of overseas buyers is gone or reduced to business actors from North Sumatra. Most likely foreign buyers will not want to buy more goods from Belawan, North Sumatra,” he said.
The ship that was detained by Lantamal I Belawan on May 4, 2022, part of its luggage, were marine and agricultural products. “Then what is the fate of our farmers and fishermen, who wants to be responsible for the immaterial losses, which can kill the lives of tens of thousands to millions of people,” he explained.
Why is it said that way, continued Sugianto, because the effect of holding one ship alone will make buyers see the image of security in the country. “Ships loaded with commodity goods can suddenly be arrested by officials who are not their job. It will definitely create legal uncertainty and trust in investing,” he explained, adding, of course, North Sumatran exporters will no longer be trusted.
He said that in the case of the detention of the MV Mathu Bhum by Lantamal I Belawan, it should not be seen from the value of the containers that were secured, but the immaterial effects that were borne were even greater.
This North Sumatran legislator asked Danlantamal I Belawan to be fully responsible for the heroic action of capturing ships in Belawan waters.
“We ask that the ship and its cargo be released. Because in detention there are no existing procedures and rules. Without a warrant of arrest, without confiscation and without a clear case determination,” said Sugianto.
He claimed to have coordinated with Customs and Excise in Belawan for the arrest of the ship. “The result of the explanation is that the MV Mathu Bhum ship did not commit any customs violations in this case smuggling or the Ministry of Trade regulation number 22 of 2022 concerning export bans,” said Sugianto.
Sugianto advised the Prosecutor’s Office not to get involved in the mistakes made by Lantamal I Belawan. “And I ask the TNI Commander to correct this. Because, in the history of this country, TNI institutions have not carried out a civil investigation process. In this case, the navy should have handed over the case to the Police, Customs and Excise or the harbormaster for the investigation and investigation process,” he said.
The PDIP faction of the North Sumatra DPRD will take steps, reporting to the President and the TNI Commander, so that in the future there will not be another incident of arrogance in the detention of other ships.
Meanwhile, representatives of North Sumatran vegetable exporters, Syahril Rudi Siregar hoped that the government would immediately resolve this case. “We do not know who is right and wrong in this case, which we hope for legal certainty,” he said.
Exporting these vegetables is a business of trust between buyers and sellers. “In this case, we are worried that buyers will distrust us as exporters of North Sumatra. Thus, there will be no more demand for vegetable exports to us,” he explained.
In the current situation, after 40 days of detention on the MV Mathu Bhum, it is certain that the vegetables (cabbage type) have been damaged. “We don’t want to send damaged goods to buyers. We have experienced double the loss of names. First, material losses and secondly, the loss of confidence of overseas buyers,” he explained.
The chairman of the North Sumatran APINDO DPP, Dr Haposan Siallagan, thanked the North Sumatran DPRD members from the PDIP faction who had accommodated the aspirations of North Sumatran business actors and MSMEs.
APINDO North Sumatra hopes that this case will get the government’s attention in terms of the DPRD as the representative of the North Sumatran people to immediately resolve the concerns experienced by business actors and MSMEs. ***
