Ahli Waris Ismael Pulungan: Sengketa Warenhuis Masih Belum Selesai • OBROLANBISNIS.com — Masih ingatkah warga Kota Medan dengan sengketa Warenhuis, gedung putih peninggalan zaman Belanda yang berdiri kokoh di Jalan Ahmad Yani VII – Jalan Hindu, Kelurahan Kesawan, Kecamatan Medan Barat, Kota Medan, Provinsi Sumatera Utara.
Perlu diingatkan kembali kepada warga Kota Medan, bahwa sengketa status kepemilikan gedung Warenhuis masih belum selesai, baik kepastian hukumnya dan juga administrasi.
“Kami para ahli waris G. Dalipsingh Bath – ODB Medan menyatakan bahwa sengketa Warenhuis ini belum selesai. Karena masih banyak lagi hal-hal yang harus dilengkapi secara bersama, secara musyawarah dan mufakat antara ahli waris dengan Pemerintah Kota Medan,” ucap Ismael N. Pulungan, sebagai salah seorang ahli waris yang berkesempatan menerima kunjungan dan bertatap muka langsung bersama sejumlah wartawan di Medan, Jumat, 13 September 2024.
Menurutnya, hak kepemilikan Warenhuis telah diperjuangan ahli waris G. Dalipsingh Bath – ODB Medan sejak tahun 2014. Bahkan, telah masuk meja peradilan tahun 2018 dan diputuskan oleh Majelis Hakim Mahkamah Agung No 68 tahun 2021, serta putusan terbaru lainnya pada awal tahun 2024 lalu.
“Kami (ahli waris Warenhuis) meminta Pemerintah Kota Medan untuk menghormati keputusan pengadilan terakhir, sembari juga membuka kembali putusan pendahulunya dari Mahkamah Agung nomor. 68 tahun 2021 yang menyatakan posisi dari ahli waris dan kemana akan dibawa terkait dengan sengketa Warenhuis,” ungkap pria berkacamata ini.
Ia mengaku, sejak awal ahli waris tidak menginginkan sengketa gedung bersejarah Warenhuis berkepanjangan. “Kita sudah membuka kesempatan untuk berkomunikasi secara baik namun hingga detik ini niatan tersebut tidak mendapat respon dari pihak Pemerintah Kota Medan bahkan Ahli Waris melihat adanya tindakan sewenang wenang,” ucapnya.
Ismail menegaskan bahwa mencuatnya kembali kasus sengketa Warenhuis ini diklaim ahli waris tidak ada unsur potensi muatan politik sama sekali. “Ini murni tentang kepemilikan swasta yang dulunya Warenhuis digunakan sebagai Supermarket, Bioskop hingga bersengketa sampai detik hari ini,” sebut Ismail.
Seluruh Ahli Waris merasa Pemerintah Kota Medan benar-benar tidak mengakui status kepemilikan Warenhuis yang dulunya dikuasai almarhum G. Dalipsingh Bath – ODB Medan sejak tahun 1934. Karena pemerintah dengan kewenangannya ingin melakukan revitalisasi Warenhuis, dengan memakai uang rakyat melalui APBD Kota Medan yang nilainya terbilang cukup fantastis.
Berdasarkan penelitian yang dilakukan oleh sejumlah pakar sejarah menyebutkan, keberadaan pengusaha etnis Tiongkhoa bernama Tan Tang Ho melalui perusahaan supermarket termewah saat itu bernama SENG HAP, telah jauh lebih dahulu ada dan sukses di Kota Medan (1860 – 1918), dan merupakan salah satu warga Tiongkhoa senior yang masuk dan berkembang di Medan.
Kondisi ini seolah telah lama menggiring opini publik dan telah merubah kebenaran sebuah sejarah kota jika Pemko tetap mengatakan Warenhuis sebagai Supermarket pertama dikota Medan.
Ahli waris juga kembali mengingatkan Pemerintah Kota Medan yang dipimpin Walikota Muhammad Bobby Afif Nasution untuk tidak memakai APBD Kota Medan dalam merevitalisasi gedung Warenhuis, karena masih berstatus sengketa, termasuk pihak-pihak lainnya secara korporasi, pengusaha ataupun perseorangan, agar berhati-hati dalam bertindak terkait dengan lahan Warenhuis.
Ahli Waris mengharapkan sengketa ini dapat terselesaikan melalui pemimpin kota Medan selanjutnya termasuk para anggota Dewan yang baru. Melalui kuasa hukumnya dari Kantor Hukum Apindosu Lajo Parmate, Ahli Waris telah melayangkan surat laporan sengketa Warenhuis kepada Ketua DPRD Kota Medan, agar menjadi perhatian, pengawasan maupun monitoring anggaran revitalisasi gedung cagar budaya Warenhuis.
“Surat tersebut telah dilayangkan kuasa hukum pada bulan Juni 2024. Dan kita masih menunggu respon dari wakil rakyat kedepan mengagenkan hak angket atau duduk bersama antara ahli waris Warenhuis dengan Pemerintah Kota Medan. Ahli Waris akan terus mengejar hak dan keadilan serta tetap memantau dan mengharapkan hukum menjadi panglima tertinggi di negeri ini yang harus ditaati,” ucapnya. ***
