Dalam waktu dekat ini, ahli waris akan mengajukan serta mendaftarkan gugatan dan langkah hukum ke meja hijau pengadilan. Dokumen-dokumen kepemilikan Warenhuis yang kini dikuasai ahli waris sedang dipersiapkan, baik surat kepemilikan zaman Belanda dengan akte surat tetanggal 13 Desember 1948 nomor 73. Awal gugatan hukum yang dilakukan ahli waris setelah pihak Pemko Medan melakukan bersih-bersih di lokasi aset Warenhuis dengan berbekal Sertifikat Hak nomor 01653 yang dikeluarkan oleh BPN di tahun yang sama dan atas persetujuan Pemerintah Kota Medan saat itu dijabat Walikota Dzulmi Eldin.
